Please review these terms as part of any Emergency Spill Response proposal. Acceptance of a proposal constitutes acknowledgment and agreement to the terms below.
This proposal is a preliminary estimate based solely on the photographs, videos, and written or verbal information provided by the Client. As no physical site inspection has been performed, the pricing is subject to adjustment based on actual field conditions encountered upon arrival.
The proposed pricing covers only the visible spill conditions represented in the information provided by the Client. This estimate assumes that the spill is limited to the areas shown and does not include contamination that is concealed, inaccessible, or extends beyond the visible affected area.
The estimated price is based on the approximate square footage, volume, or quantity of contaminated material visible in the photographs. Upon arrival, Emergency Spill Response will measure and document the actual affected area.
If the contaminated area, volume of spilled material, or quantity of contaminated soil exceeds the original estimate, the contract price will be adjusted based on the actual quantities encountered. Additional charges may include excavation, absorbent materials, labor, equipment, transportation, waste profiling, laboratory analysis, treatment, disposal, backfill, and site restoration, as applicable.
Emergency spills may migrate beneath equipment, into soil, concrete, asphalt, subflooring, utility trenches, storm drains, retention areas, or other locations not visible in photographs. Any contamination discovered beyond the visible spill area that requires additional containment, excavation, remediation, or restoration shall be considered outside the original scope of work and billed as additional services.
This estimate is based on the assumption that the spilled material matches the description and Safety Data Sheet (SDS), if provided, by the Client. If the material is determined to be different, more hazardous, mixed with other contaminants, or requires specialized handling, personal protective equipment (PPE), analytical testing, or disposal methods, Emergency Spill Response reserves the right to adjust the pricing to reflect the actual conditions.
Emergency response charges begin when the response vehicle departs the Company's facility (portal-to-portal) and continue until personnel and equipment return to the facility. If the response is delayed, canceled, or significantly differs from the conditions represented by the Client after mobilization has occurred, applicable mobilization, travel, labor, and equipment charges will remain billable.
Waste transportation and disposal fees included in this estimate are based on the anticipated waste type and estimated quantities. Final disposal charges will be based on the actual waste profile, certified disposal facility acceptance requirements, manifest quantities, scale weights, laboratory analysis, and applicable regulatory fees. The Client acknowledges and agrees that they remain the legal Generator of the waste unless otherwise agreed to in writing.
If actual site conditions differ materially from those represented by the Client, Emergency Spill Response reserves the right to revise the scope of work and adjust the contract price accordingly. Whenever reasonably practicable, the Client will be notified and authorization obtained before performing work outside the original scope.
Acceptance of this proposal constitutes acknowledgment and agreement to these Terms & Conditions.
The Client understands that emergency response work often involves unknown site conditions that cannot be fully evaluated until personnel arrive on-site and remediation activities begin.
